Mr. Kushner's failures to disclose on his security application his meetings and communications with high-ranking Russians has likely put a target on his forehead. Presumably, he signed under penalty of perjury as true, correct and complete. He may well have been interviewed by federal agents as part of the application process. This seems an intentional omission when coupled with, among other communications with Russian representatives, his efforts to use Russia's secure communications apparatus as a means for the incoming administration to chat with the Kremlin. Perjury or "false statements" on the application for the highest levels of security is its own crime, separate and apart from, say, obstruction of justice, treason, misprison of treason, espionage, accessory or accessory after the fact.
18 U.S.C. 1001, False Statement, provides:
(a) Except as otherwise provided in this section, whoever, in any matter within the jurisdiction of the executive, legislative, or judicial branch of the Government of the United States, knowingly and willfully—
(1) falsifies, conceals, or covers up by any trick, scheme, or device a material fact;
(2) makes any materially false, fictitious, or fraudulent statement or representation; or
(3) makes or uses any false writing or document knowing the same to contain any materially false, fictitious, or fraudulent statement or entry; shall be fined under this title, imprisoned not more than 5 years . . . .
Word is General Flynn was in the meeting at the Trump Tower in very early December last year. In a prior post I discussed General Flynn's attempts to earn a get-out-of-jail free pass by sharing the story he so desperately wants to tell.
Is such an avenue available to Mr. Kushner? My guess, and it's only a guess, is he has the goods on Mr. Trump who is a whale of a bigger fish than Mr. Kushner. As the walls in this Banana Republic continue closing in, which exit door will Ivanka take?
